G2K USER AGREEMENT

Welcome and thank you for choosing Gene2Know! We hope that this will be the beginning of a long and wondrous journey together, as we guide you on your way to better living. What follows is meant to welcome you to the Gene2Know family and explain how we do things; we want you to feel comfortable that we are forever in your corner as we provide you with your genetic key to a healthier and happier you.

In an age of information overload and online data collection, Gene2Know places the privacy of our customers at the top of the list. Our security systems are state of the art. It is our goal to provide the best possible protection of the information we collect from our customers.

Before using the services of Gene2Know, we must get the legal stuff out of the way. In order for you to join the Gene2Know family, you must agree to the Terms of Service as outlined herein. Your use of any of the products and services provided by Gene2Know is your agreement and consent to these terms of service.

G2K TERMS OF SERVICE

1.0 ELIGIBILITY

1.1 In order to use our services, you must be at least 18 years old. Parents and legal guardians may use services for their minor children.

 

2.0 NO MEDICAL ADVICE GIVEN

2.1 The services provided by Gene2Know are for informational purposes only. Gene2Know services are NOT INTENDED TO BE A SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE, DIAGNOSIS, COUNSELING OR TREATMENT.
2.2 You should NEVER stop or change your prescription medication instructions without first consulting with your prescribing physician or healthcare provider.
2.3 Reliance on any information provided by Gene2Know is solely at the risk of the user. If you have any questions or concerns about your results, you should seek professional medical advice from an appropriate healthcare provider near you before making any changes to your lifestyle or medication management.

 

3.0 DNA SERVICES

You acknowledge, consent, and agree to the following:

3.1 You will not submit a sample (saliva or blood) that is not your own or that of a person for whom you are the parent or legal guardian.
3.2 You will not submit a sample (saliva or blood) if you have reason to believe that you have an active infectious disease.
3.3 You understand that this product is not intended to diagnose, treat, cure, or prevent any disease.
3.4 You authorize Gene2Know (and its affiliates and partners) to conduct testing with the submitted DNA specimen.
3.5 You authorize Gene2Know (and its affiliates and partners) to store your DNA sample as necessary and you understand that your sample may not be returned to you.
3.6 You represent and warrant that you have obtained all permissions, consents and authorizations necessary from the person(s) submitting DNA specimens (or the parent / guardian of such person(s) if under 18).
3.7 You understand that the specimens were collected without a strict chain of custody, and their origins cannot be verified. Therefore, the results may not be admissible in a court of law.
3.8 You acknowledge and understand that if for any reason the biological specimens are inadequate for evaluation, Gene2Know (and its affiliates and partners) shall not be held liable for its inability to produce test results due to insufficient specimen or due to the nature or condition of the specimen. Gene2Know (and its affiliates and partners) may request additional samples for further testing.
3.9 You understand that results will be sent based on the delivery information provided during barcode registration as soon as results are available to be sent. It is your responsibility to provide delivery information that assures any privacy needs that I may have.
3.10 You understand that by providing a DNA sample (saliva or blood) that you do not acquire any ownership interest in any research or commercial products developed by Gene2Know or our partners and affiliates.
3.11 You understand that if you choose to download your DNA data that you are responsible for securing and protecting your DNA data, and that Gene2Know will not be able to protect any data that you download.

 

4.0 RISKS

4.1 With knowledge comes power and responsibility. You may learn things about yourself that you did not expect or you did not want to know. Finding out that a parent is not a biological parent or that you carry a rare genetic disorder may not be something you are ready for. You should consider these and other unexpected discoveries BEFORE you order your kit and BEFORE you order any of our services.
4.2 As with any online resource, there is an inherent risk of a data breach. While Gene2Know employs the latest in data security and protection, invincibility from outside data breach is an impossible standard to meet. In the unlikely event of such a breach, Gene2Know will notify you immediately that your data may have been compromised and will take what measures are available to us solve the breach and limit its impact.

 

5.0 LIMITATIONS OF LIABILITY

5.1 YOU ACKNOWLEDGE AND AGREE THAT GENE2KNOW’S (AND ITS AFFILIATES AND PARTNERS) LIABILITY TO YOU ARISING OUT OF, OR IN ANY WAY RELATED TO, THE PROVISION OF TESTING SERVICES CONTEMPLATED HEREIN SHALL NOT EXCEED THE COST OF THE TEST, AND YOU AGREE TO INDEMNIFY, DEFEND, AND HOLD GENE2KNOW (AND ITS AFFILIATES AND PARTNERS) AND ITS EMPLOYEES HARMLESS FROM ALL FURTHER CLAIMS OR DAMAGES.

 

6.0 GOVERNING LAW

6.1 You agree that in any dispute arising out of the use of Gene2Know’s services and technology that the law of the State of Florida, and to the extent applicable, the laws of the United States of America, shall govern.

 

7.0 JURISDICTION

7.1 Any dispute arising out of the use of Gene2Know’s services and technology shall be brought in the State of Florida; if in Federal Court, suit shall be brought in the United States District Court for the Middle District of Florida; if in State Court, suit shall be brought in the Sixth Judicial Circuit, in and for Pinellas County, Florida.

 

8.0 MISCELLANEOUS

8.1 If you have any questions about our security practices, privacy practices or terms of service, please email us at legal@gene2know.com.  We CANNOT give you legal advice, but we are happy to explain the terms contained herein.  You may also send a letter to our corporate headquarters.

 

9.0 CHANGES TO THE TERMS AND CONDITIONS 

9.1 We may modify and update the terms and conditions from time to time, but you will always be provided with notice of any material changes made.  If you continue to use our services after having received notice of any changes herein, you consent to the changes made.

 

10.0 Important Information about Pharmacogenetics (PGx), & Allergy Testing

Pharmacogenetics (PGx) is not full proof and it is still possible to have an Adverse Drug Reaction (ADR) even though your PGx test indicates a medicine, supplement or food is safe for you.

Pharmacogenetics is a constantly growing field. Our PGx Test & Reports are State of the Art; however, while researchers have made amazing strides in identifying genotypes that increase the risk of ADRs, and the former risk of ADRs has been greatly diminished by the use of PGx, there may be unidentified factors that lead you to have an Adverse Drug Reaction.

The same is true of Allergy Testing. Our Allergy Testing is State of the Art and we stand by it; however, as with all testing, there are limitations affecting accuracy. It is impossible to have a test that is 100% accurate with all people all of the time. You may have an allergic reaction even though your G2K Allergy Test does not indicate you are allergic.

You should never rely solely on your G2K PGx or Allergy Test when making medical decisions, or other lifestyle decisions. G2K PGx is meant to be a tool in those decision-making processes that you can share with experts. You should always consult a medical doctor or other expert before making important lifestyle decisions.
